Terms of Service
These Terms of Service ("Terms") govern your use of the STA7US iOS application and the website at sta7us.app and sta7us.com (together, the "Service"). The Service is provided by Samuel Kittinger, Magdalenenstraße 15/20, 1060 Vienna, Austria ("we", "us").
By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
STA7US is a personal discipline and habit tracking application. It provides a structured daily protocol, progress tracking, a tier system, and reminders. The Service is intended for personal informational use only and does not constitute medical, fitness, psychological, or any other professional advice.
2. Subscription and free trial
2.1 Pricing
Access to STA7US is sold as a monthly subscription at €4.99 per month (or local equivalent), with a 3-day free trial for new subscribers.
2.2 Trial
The 3-day free trial begins when you start the trial. During the trial, you have full access to the app. If you do not cancel before the trial ends, the subscription automatically converts to a paid monthly subscription.
2.3 Billing
Payment is processed by Apple through your Apple ID. The subscription auto-renews monthly until cancelled. You can manage and cancel your subscription at any time in iPhone Settings → Apple ID → Subscriptions, at least 24 hours before the end of the current period.
2.4 Refunds
Refund requests are handled by Apple. We do not process refunds directly. You can request a refund at reportaproblem.apple.com.
2.5 Right of withdrawal (Austrian / EU consumer law)
Under the Austrian Distance Selling Act (FAGG), consumers in the EU have a 14-day right of withdrawal for digital services. By starting the free trial and using the Service immediately, you expressly consent to the Service being made available before the end of the withdrawal period and acknowledge that you lose your right of withdrawal once the Service has been fully provided. The 3-day free trial functions as a satisfaction period during which you can cancel without any charge.
3. Your account and use
3.1 Eligibility
You must be at least 16 years old to use the Service. By using the Service, you confirm you meet this requirement.
3.2 Acceptable use
You agree not to:
- Reverse engineer, decompile, or attempt to extract source code from the app
- Resell, sublicense, or share your subscription with others
- Use the Service in any unlawful way or for any unlawful purpose
- Attempt to circumvent the subscription system or access paid features without paying
3.3 Your responsibility
You are responsible for any decisions you make based on information from the Service. The protocols, suggestions, and content in the app are general guidance, not personal medical or professional advice. Consult a qualified professional before starting any new fitness, dietary, or psychological practice — particularly if you have a pre-existing condition.
4. Intellectual property
All content in the Service — including the app, website, branding, copy, design, the STA7US name and logo, and all written material — is owned by us or our licensors and protected by copyright and trademark law.
We grant you a personal, non-exclusive, non-transferable, revocable license to use the app for the duration of your subscription, for personal use only. No other rights are granted.
5. Health and safety disclaimer
STA7US contains suggestions for cold exposure, breathing exercises, fasting, supplementation, and physical training. These are not medical advice. Use them at your own risk. If you have any pre-existing condition, consult a doctor before practicing them. Stop immediately if you experience pain, dizziness, or other adverse symptoms.
6. Service availability
We aim for high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or factors outside our control. We are not liable for downtime.
7. Limitation of liability
To the maximum extent permitted by law, our liability is limited as follows:
- We are liable without limitation for damage caused intentionally or by gross negligence, and for damage to life, body, or health.
- For damage caused by simple negligence, we are liable only for breach of essential contractual obligations and only up to the amount of foreseeable typical damage.
- We are not liable for indirect or consequential damages.
Mandatory consumer protection rights under Austrian law (KSchG) remain unaffected.
8. Termination
You can cancel your subscription at any time via your Apple ID Subscriptions page. Cancellation stops auto-renewal; you retain access until the end of the current billing period.
We may suspend or terminate access if you breach these Terms. In serious cases (e.g., abuse, fraud, illegal use), we may terminate without notice.
9. Changes to these Terms
We may update these Terms occasionally. Material changes will be communicated via email or in the app. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
10. Governing law and jurisdiction
These Terms are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction for disputes with consumers is determined by the mandatory provisions of Austrian consumer law (KSchG).
For consumers, the European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
